Hope Care SA, hereinafter referred to as Hope Care, considers the protection of our customers’/users’ privacy to be a task of paramount importance.

In this regard, this privacy policy aims to guarantee all our customers/users complete security when using our website, describing who we are, for what purposes we may use your data, how we process it, with whom we share it, how long we keep it, as well as how to contact us and exercise your rights.

Hope Care processes and stores personal data in accordance with best practices in the field of security and protection of personal data, having taken the necessary technical and organisational measures to comply with the General Data Protection Regulation (Regulation (EU) 2016/679), which is a legislative act directly binding on natural and legal persons who, whether resident in the EU or not, process data of European Union citizens and which aims to ensure that the processing of personal data is lawful, fair, transparent and limited to the authorised purposes, and also by Law 58/2019 of 8/8, which ensures the implementation, in the national legal order, of the General Data Protection Regulation.

The data requested in the forms is mandatory, otherwise we will not be able to provide the service.

The privacy statement is the responsibility of Hope Care S.A., headquartered at Parque Tecnológico de Óbidos, Rua da Criatividade, Edifícios Centrais, 2510-216 Óbidos, which is considered the data controller for the purposes of the GDPR and will determine the purpose and means of processing personal data submitted and collected online.

By accepting this Privacy Policy, the Customer/User is informed and gives their free, specific and unambiguous consent to the processing of their personal data provided on our website, together with browsing data and other data provided to Hope Care in the future.

The user should carefully read this Privacy Policy, which has been written in a clear and simple manner to facilitate understanding, so that they can freely and spontaneously decide whether they wish to provide their personal data to Hope Care.

By using this website, you are agreeing to the practices described in this privacy policy. If you do not agree with this privacy policy, we advise you not to use this website. Hope Care reserves the right to make changes to this privacy policy at any time without prior notice. Any changes will be posted on this privacy policy, and material changes will generally apply to future activities and data collected. We advise you to check this privacy policy regularly to ensure that you are aware of any changes and how your data may be used.

What personal data do we process?

Hope Care collects and processes the following personal data:

– Identification data: name, surname, nationality, age, gender, weight, height, ethnicity, identification document data (Civil Identification number; Tax Identification number; date of birth, and photograph)

– Contact details: email address, telephone number, personal address,

  1. – Browsing data: serial number of your personal digital assistant (i.e. iPhone, iPod Touch, iPad or Android device).

    What does personal data processing involve?

    The processing of personal data consists of an operation or set of operations performed on personal data or sets of personal data, whether by automated means or not, including collection, recording, organisation, structuring, storage, adaptation, retrieval, consultation, use, disclosure, dissemination, comparison, interconnection, restriction, erasure or destruction.

    As a rule, Personal Data is required to create an account protected by a username and password. To do this, you must provide your email address as your username and a password of your choice. Your email address may be used to send you Electronic Communications when necessary.

Processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures;

Purpose/Justification for Personal Data Processing.

In general, the personal data collected is based on and intended for the management of the contractual relationship, the provision of contracted services, the adaptation of services to the needs and interests of the Customer/User, namely for the use of our software and applications.

Your personal information to use the Software will be requested to create an account protected by a username and password. To do this, you must provide your email address as your username and a password of your choice. Your email address may be used to send you Electronic Communications when necessary. In addition, while using the Software, you may be asked to voluntarily provide certain personal information (such as gender, weight, height, date of birth, ethnicity, and other data required by the software to calculate health risk indicators and colour the graphs) for purposes such as using certain special features of the Software.

The Software is a tool that uses tables, graphs, and mathematical calculations to allow you to track your data entered into the Software over time and to compare your data with standardised values and values for the general population. The Software is for your personal, educational, informational, entertainment, and convenience use only.

Use of Bluetooth Devices – The Software can be connected via Bluetooth technology to health parameter measurement devices. The manufacturers of these devices have chosen to use Bluetooth LE (low energy) communication as a means of providing a ‘real-time’ experience for users, allowing immediate retrieval of data from their devices. The Software does not use Bluetooth for any other purpose. If the customer/user does not wish to have their personal information transmitted via Bluetooth, they can disable Bluetooth on their smartphone or similar device in the settings application for that device, or they can simply not connect (or disconnect if already connected) devices that require Bluetooth on the Software’s eHealth page.

Use of location data – At the user’s discretion, the Software can be connected via Bluetooth technology to health measurement devices, and for better connectivity and use, it is necessary to activate Location. The Software does not use location data for any purpose other than connecting Bluetooth medical devices. No location data is sent to Hope Care servers. If you do not wish to activate your Location, you can disable Location on your smartphone or similar device in the settings application for that device. Disabling Location will affect the use of various Bluetooth medical devices.

Hope Care may use your personal information to contact you and correspond with you, to respond to your enquiries, to monitor communications exchanged, to carry out your requests for backups of personal information, to assist in the management of your weight and related health information, generate aggregate statistics for software users, help Hope Care develop new software services and features that meet your needs, improve the software, and provide you with requested electronic communications or those we think may be of interest to you.

In addition, personal data may also be processed for the purposes of complying with legal obligations and for the investigation, detection and prosecution of serious crimes.

For any other use not defined in the previous points, Hope Care guarantees the prior consent of the data subject.

Retention period:

The period during which personal data is stored and retained varies according to the purpose for which the information is processed.

Indeed, there are legal requirements that oblige us to retain data for a minimum period of time. Hope Care may store and process your personal data for a period of time during which your account remains active and for a period of twelve months after you delete your account. After this time, Hope Care will delete your stored personal information. Hope Care stores this information in offices located in Portugal or elsewhere in Amsterdam, and its servers may be located elsewhere as part of a cloud computing-based architecture with the server capacity being leased from a third-party provider.

Age of majority:

By accepting this privacy policy, the Customer/User guarantees that they are 18 years of age or older.

The Customer/User also guarantees that the data provided is true, accurate, complete, and current. For these purposes, the user is responsible for the accuracy of all data disclosed and must keep the information provided up to date so that it reflects their current situation.

Sharing of personal data:

Hope Care may transfer or disclose your personal information to its employees, agents and consultants if the disclosure allows those parties to perform business, technical support or professional functions for Hope Care.

Such parties will be subject to the same obligations as Hope Care under this Policy.

Hope Care may be involved in the sale or transfer of some or all of its assets or other transactions. As part of that transaction, Hope Care may disclose your personal information to the acquiring organisation or other organisation involved in the transaction, to the extent permitted by law, but will require such organisation to agree to protect the privacy of your information in full compliance with this Privacy Policy.

Hope Care guarantees that it does not intend to transfer data to third countries outside the General Data Protection Regulation and, if it does so, it will ask for your consent.

Processing security:

Hope Care is committed to ensuring the protection of the personal data made available to it and has approved and implemented strict rules in this regard. Compliance with these rules is an obligation for all those who legally access such data.

Bearing in mind Hope Care’s concern and commitment to the protection of personal data, various technical and organisational security measures have been adopted in order to protect the personal data made available to it against its dissemination, loss, misuse, alteration, unauthorised processing or access, as well as against any other form of unlawful processing.

Hope Care employs security measures such as “https” appropriate to the sensitivity of the information.

However, due to the nature of the Internet and Internet technologies, security and privacy risks cannot be completely eliminated, and Hope Care cannot fully guarantee that your personal information will not be accessed in ways not contemplated in this Policy.

Access, rectification, or deletion of personal data:

As the data subject, the Client/User has the right to request access to their data, to request its rectification, and to request its deletion. You may also limit the processing of your data, object to it, and request data portability.

You may do so directly or by written request addressed to the respective Controller, using the contact information provided for this purpose in this document.

You may also file a complaint with the CNPD – National Data Protection Commission, located at Av. D. Carlos I, 134 – 1st floor, 1200-651 Lisbon, telephone (+351) 213928400, whenever you believe that your rights are being violated.

Right of access:

The data subject has the right to obtain from Hope Care confirmation as to whether or not personal data concerning him or her are being processed and, if so, access to the personal data and the information provided for by law.

Right to rectification:

The data subject has the right to obtain from Hope Care, without undue delay, the rectification of inaccurate or incomplete personal data concerning him or her.

Right to erasure of data (“right to be forgotten”)

The data subject has the right to obtain from Hope Care the erasure of their data without undue delay, and Hope Care has the obligation to erase personal data without undue delay when one of the following grounds specifically applies:

a) The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;

b) The data subject withdraws consent on which the processing is based (where the processing is based on consent) and there is no other legal basis for the processing;

c) The data subject objects to the processing and there are no overriding legitimate interests justifying the processing;

Right to restriction of processing:

The data subject has the right to obtain from Hope Care the restriction of processing if one of the following situations applies:

a) The accuracy of the personal data is contested by the data subject, for a period enabling Hope Care to verify its accuracy;

b) The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;

c) Hope Care no longer needs the personal data for processing purposes, but they are required by the data subject for the establishment, exercise or defense of legal claims;

d) The data subject has objected to processing, pending verification whether the legitimate grounds of the controller override those of the data subject.

Right to Data Portability:

If processing depends on the data subject’s consent and that consent has been given by automated means, the data subject has the right to receive the personal data concerning him or her that he or she has provided to Hope Care in a structured, commonly used and machine-readable format.

Right to Object:

In cases where data processing is carried out for:

1) the purposes of the legitimate interests pursued by Hope Care; or

2) data processing is carried out for direct marketing purposes or

3) profiling, you may also, at any time, object to the processing of your personal data.

Marketing Emails:

Data controllers are permitted, after explicit consent, to send marketing emails to website users. At any time, the user may withdraw their consent via the link provided for this purpose in each email sent.

Changes to this Policy:

This policy may be updated from time to time, for example, due to changes in relevant legislation. If any material changes are made, customers will be notified by email or by notification on the website.
